Errr, fansubs are legal. They are created before the anime is licensed in North America(or any other country other than Japan). They become illegal once the anime is licensed... Furthermore, Fansubs are free...They are created by fans for fans and are not supposed to be distributed for profit.

Subbed are licensed versions of the anime. Usually more funding goes toward these, so they are better translated. These are legal(but you have to pay [IMG] )

I only recently started hunting up fansubs m'self. Only downloading the digisubs. I'd seen a few hard-copy VHS ones before through friends. Usually if I like a series I've seen fansubbed enough, I'll buy it when it's produced comercially here.
As for their legality... that's kinda a undecided point... Technically they're not legal (official copyright n'all that), but it does exist in a lovely little gray area. It puts publicity out for a series, n'some shows probably wouldn't have been licensed to begin with if not for an emense fansub following.
